What It Is, What It Isn’t, and What Families Should Know When someone dies, their family may hear the word probate and immediately feel overwhelmed. Probate can sound complicated, but at its simplest, it is the legal process used to settle certain parts of a person's estate after death. Probate may involve identifying the person's assets, paying valid debts and expenses, determining who is legally entitled to receive property, and transferring assets to the appropriate people. In Massachusetts, the Probate and Family Court oversees this process. What Probate Is NOT Probate is not automatically a fight over an inheritance. It does not mean that the family has done something wrong, and it does not necessarily mean that the estate will take years to settle. Probate also does not mean that every asset a person owned must go through probate. Some assets may pass directly to another person through joint ownership, beneficiary designations, trusts, or other legal arrangements. What Happens When There Is a Will? If the person who died left a valid will, the will generally explains how they wanted their probate property distributed. The person named as executor may be responsible for handling the estate, although the court must formally appoint or recognize the appropriate personal representative. The personal representative may need to locate assets, notify interested parties, pay approved expenses and debts, file required paperwork, and distribute the remaining estate according to the law and the will. What If There Is No Will? When someone dies without a valid will, they are considered to have died intestate. Massachusetts law then determines who may inherit the probate estate. This is one reason estate planning can be so important. A will can help make a person's wishes clearer and may make things easier for the people left behind. What About the Family Home? A home can be one of the most important—and emotional—parts of an estate. If the property is part of the probate estate, the family may need to determine whether it should be sold, transferred to an heir, or handled in another way. Before making decisions about a property, it is important to understand who has legal authority to act and whether court approval or other steps are required. There may also be practical decisions involving repairs, insurance, maintenance, personal belongings, cleanout, valuation, and the eventual sale of the property. How Long Does Probate Take? There is no single timeline that applies to every Massachusetts estate. The length of the process depends on the size and complexity of the estate, whether there are disagreements, whether property must be sold, and whether there are debts, taxes, or other issues to resolve. Some estates are relatively simple. Others require considerably more time. The Most Important Thing to Remember Probate is a legal process—not a race. Families dealing with an inherited home are often making decisions while also dealing with grief, memories, family responsibilities, and sometimes complicated relationships. It is okay to slow down, ask questions, and get the right professional advice before making major decisions. An attorney can provide legal guidance about the estate and probate process. Tax and financial professionals can help with their areas of expertise.
